Silicosis Diagnosis Fraud Investigated in Texas

At a glance:

The Attorney General of Texas has launched his own investigation into suspicious litigation of silicosis claims. 
 
There is already a congressional probe into the issue, and courts are taking another look at asbestos claims as well. 
 
The possibility of fraud came to light when some doctors, testifying in such cases, withdrew their diagnoses. Some doctors also refused to testify under the 5th Amendment for the congressional inquiry. 
 
Unfortunately, silicosis and asbestosis are real diseases with real victims of occupational negligence; dismissal of claims en masse, which defendants are requesting, means real litigants will have to start over.


State probes fraud claims in silicosis diagnoses

HARLINGEN — State Attorney General Greg Abbott has subpoenaed documents for a grand jury investigation into thousands of potentially fraudulent diagnoses of the occupational lung disease silicosis.
 
The May 25th subpoena to Omni Litigation Services requests all documents from cases from several states consolidated in Corpus Christi in February of 2005. Omni was the depository for court documents
