Tobacco Damages Overturned; Liability Remains

The verdict was upheld, only the amount is in question, with regard to a lawsuit against Philip Morris USA. 
 
The company was found guilty of negligence and fraud, and held liable in the death of an Oregon smoker because of its claims that low tar cigarettes were safer than regular cigarettes. 
 
The original amount awarded was $150 million; that was later reduced to $100 million but the appeals court found that to be excessive as well and ordered a new trial to set damages.


Court Overturns Tobacco Verdict

PORTLAND, Ore. — A landmark $150-million jury verdict against Philip Morris USA was vacated Wednesday by an appeals court, which ordered a new trial to reconsider damages after a circuit judge ruled that the amount was excessive.
 
The March 2002 verdict, which was later reduced to $100 million, was the first such award in the U.S. based on claims that smokers were led to believe that low-tar cigarettes were less dangerous than regular cigarettes.
