First Trial to Begin in July, for Recalled Defibrillator Lawsuit

First the recall, now the lawsuits: the first lawsuit against Guidant to go to trial will begin in July, according to the Texas judge presiding over the case. 
 
The charges are fraud and deceptive trade pracices. Plaintiffs contend that Guidant knew that its defibrillators, implanted in the plaintiffs' chests, might be defective, but did not warn them. 
 
Guidant maintains it acted properly. 
 
Over 200 such lawsuits impend, with perhaps hundreds more to follow.


Guidant Trial on Recalled Heart Devices Will Be Postponed

The Guidant Corporation's first trial over a recalled defibrillator, scheduled to start in Texas this month, was postponed because a witness will be unavailable during the Passover period.
 
The judge in the case, Jack Hunter of Texas State Court in Corpus Christi, said yesterday that he now expected the trial to begin in July. Two plaintiffs, Louis Motal, 63, and Bernice Hinojosa, 65, have filed a lawsuit contending fraud and deceptive trade practices by Guidant, which makes implanted electronic heart-rhythm devices
