Class Action Suit Against Merck to go Ahead

A wide-ranging class action suit by insurance companies and HMOs was given the go-ahead by a New Jersey appeals court in one of the many lawsuits against the drug company Merck regarding its pain killer Vioxx. 
 
(This is not to be confused with the thousands of individual lawsuits against Merck filed by patients claiming harm because they were not informed of the risks of stroke and heart attack associated with Vioxx. Merck is fighting those suits one at a time.) 
 
Merck intends to appeal the appeal.


Judge says class-action Vioxx lawsuit can proceed

A New Jersey appeals court Friday upheld a class-action lawsuit against Merck from some plaintiffs alleging they were misled regarding the risks of the painkiller Vioxx.
 
The appellate court ruled that Judge Carol Higbee of New Jersey Supreme Court was proper in certifying a nationwide class. The class action suit was filed by private insurers and HMOs, and is separate from the nearly 10,000 lawsuits filed by patients, or families of patients, who took the painkiller Vioxx.
