Class Action Suit in Utah Loses Lead Plaintiff

The longest-standing class action lawsuit in Utah has outlived its lead plaintiff. 
 
Richard Madsen, 76, has died of Parkinson's Disease; however his wife Nancy Madsen will represent the class of more than 9,000 who are suing Washington Mutual Bank. 
 
The case, filed in 1975, has to do with proceeds from advance payments to mortgage company Prudential Federal Savings and Loan, since acquired by Washington Mutual.  
 
Instead of being credited to the mortgage holders, these advance payments went into a general fund with proceeds going to the company, not the individuals. 
 
Details of how a $1 million judgement will be allocated, are being negotiated.

The plaintiff in one of the state's longest civil lawsuits has died.
 
With the passing of Richard Madsen, 76, who suffered from Parkinson's disease, his wife, Nancy Madsen now will represent more than 9,000 people who stand to get a portion of a $1 million judgment in Madsen's 32-year-old class-action lawsuit against Washington Mutual Bank.
