Cell Therapeutics Class Action Lawsuit Dismissed

A US District Court Judge has granted a motion to dismiss a class action lawsuit against cancer drug maker Cell Therapeutics Inc. 
 
The lawsuit alleged false statements by the company concerning trials of lung cancer drug Xyotax. Investors who bought Cell Therapeutics stock between November 2003 and March 2005 claim the company made money on stock offerings under false pretenses. 
 
The drug is still being tested.

(RTTNews) - Friday, cancer drug maker Cell Therapeutics, Inc. said U.S. District Judge Ricardo Martinez has granted its motion to dismiss a private securities fraud class action lawsuit. The lawsuit F.L. titled Heywood, et al, was filed on November 7, 2005 and alleged of making false statements by company officers. The Judge's decision was issued May 4 but went into permanent effect on June 8, 2006.
