State Farm Lawsuit to Go Ahead in MIssissippi

At a glance:

State Farm has lost a round in a lawsuit over hurricane damage in Mississippi.

A judge ruled that the wording in State Farm's policy was "ambiguous" and "unenforceable" because it contained some contradictions - for example, coverage due to wind damage would be denied if the wind acted together with an excluded event such as tidal surge.

Parts of the policy's wording excluded wind and rain damage while other parts included it, and there was a "hurricane deductible".

The lawsuit was not dismissed as State Farm had requested, and a trial will be scheduled.

A couple whose Long Beach home was damaged by the Aug. 29 storm is suing State Farm for denying their claim, arguing that the wording of their policy's "flood exclusions" are ambiguous and cannot be enforced.
