Opening Statements in California Vioxx Trial

The first Vioxx trial to be held in California is under way.  
 
In opening statements, the plaintiff's lawyer said that Merck was aware of Vioxx's risks as far back as 1996 and did not inform doctors. Furthermore, the company specifically trained salespeople to downplay the risks. 
 
Stewart Grossberg claims the drug caused his heart attack and that Merck was misleading in its advertising and negligent. Merck says there is no proof that Vioxx caused the heart attack, that the plaintiff had other risk factors, and that the suit is frivolous.

Merck & Co. knew of potential harmful side effects of its drug Vioxx and failed to notify doctors, a lawyer for a man who claims the painkiller caused his heart attack said Tuesday in opening statements of the first Vioxx liability case to go to trial in California.
 
"Merck knew of these potential side effects and never told a soul," said attorney Thomas Girardi, who represents plaintiff Stewart Grossberg
