Merck Objects to Testimony for Future Vioxx Trial

Lawyers for drug company Merck are trying to suppress some testimony from an upcoming Vioxx trial. An FDA researcher, Dr. David Graham, made a video deposition in which he alleged that for two years, Merck resisted FDA requests to change the labelling on Vioxx to reflect what was becoming known about the risk of heart attacks and strokes with the drug.  
 
Other testimony that Merck wants striken concerns the researcher's opinion that Vioxx should not have been approved at all and that Merck should have done larger studies earlier on.

NEW ORLEANS - Some video testimony for federal Vioxx trials by FDA whistle blower Dr. David Graham goes beyond anything he has said previously and shouldn't be heard by jurors, attorneys for manufacturer Merck & Co. said.
 
That includes an allegation that Merck dragged its feet about changing the label on the once-popular painkiller to warn it might increase the chance of heart attacks, according to a 22-page document added to the court record this week
