Vioxx Lawsuits to Begin in California

At a glance:

Two Vioxx lawsuits are set to go to trial later in June in California. Both involve men who had heart attacks and were taking Vioxx.  
 
Merck is trying to stop one of those cases before it starts, by moving for summary judgement on the grounds that the statute of limitations had run out on the lawsuit; that motion will be heard by a judge on June 15. 
 
The cases commence as conflicting evidence has emerged about how long Vioxx must be taken before the risks emerge, and whether the risks persist after Vioxx is stopped.


Merck Goes for Early Knockout in Calif. Vioxx Case

With only a few weeks before the start of its first California trial involving Vioxx, Merck & Co. is seeking to have one of the cases thrown out on statute of limitations grounds.
 
The move comes shortly after Merck was hit with a recent jury verdict in Texas, and after damaging new data surfaced about the potential dangers of the pain reliever.
