Merck Wins Victory in Federal Court Over Vioxx

Merck sealed an important victory as they won the first federal court case over the painkiller Vioxx. The jury ruled that the drug maker was not responsible for the death of a Florida man because he had numerous risk factors for heart attack and had only been taking Vioxx for one month.
Although it has been proven that Merck was not entirely up front about the high risk of heart attacks when taking Vioxx, it has been noted that most victims of heart problems related to Vioxx had been taking the medication for more than 18 months. This was an important victory for Merck, but they face over 9,000 lawsuits over Vioxx and its side effects.

In its first victory in federal court over the once popular painkiller Vioxx, a jury in New Orleans ruled that Merck & Co. was not responsible for the death of a 53-year-old Florida man who had a heart attack after taking the drug for less than a month.
 
The victory Feb. 17 was the company's second in court regarding Vioxx. Merck argued that plaintiff lawyers never proved any link between Vioxx and the heart attack Richard "Dickey'' Irvin suffered in 2001. Merck's lawyers contended Irvin's age, gender and diet all put him at risk fo
