Merck Loses Vioxx Trial in New Jersey

At a glance:

On the one hand, the plaintiff in this Vioxx case had so many other illnesses, it looked like it would be difficult to prove that Vioxx actually affected him; on the other, it was easy to prove that had he known the risks, he would not have chosen to take Vioxx in the first place.
 
The upshot was, the jury awarded the plaintiff, John McDarby, $9 million in punitive damages and $4.5 million in compensation.
 
Appeals are of course pending.
 
This was the first Vioxx trial in which the plaintiff took the medication for more than the 18 months that Merck now admits is hazardous.

ATLANTIC CITY, N.J. -- At first, John McDarby's case looked like a loser. Frail, elderly and confined to a wheelchair after two broken hips, he was a 77-year-old diabetic with clogged arteries.
 
Not exactly the kind of victim likely to win over a jury with his claim that a painkiller made by Merck & Co. was to blame for his illness. Or so many people thought last fall, when Merck chose McDarby's case as the next involving Vioxx to go to trial.
