Spouse of Paralyzed Woman Denied Settlement Under Statute of Limitations

An expired statute of limitations caused a US District Court Judge to nullify a $5 million judgement against the former American Cyanamid Co. (currently Wyeth Holdings Corp.)
 
The suit was filed by an Indiana man whose wife became a paraplegic in 1991 after contracting polio from a child who was given defective polio vaccine.
 
The woman, Cathy Price, had received a settlement under the National Childhood Vaccine Injury Act of 1986 but that did not preclude her husband from suing for his own damages; however he filed that suit too late.
