Part of WR Grace Asbestos Indictment Thrown Out

Part of the indictment against W.R. Grace & Co. on asbestos-related issues was dismissed on the grounds that the statute of limitations had run out. 
 
The charge of consipiracy, that is, knowingly endangering workers and residents, has a five year limit. 
 
The company operated a vermiculite mine in Libby, Montana until 1990. It was later discovered that mining operations caused asbestos to be released. Many residents of the town have since been diagnosed with asbestos-related illnesses.

A federal judge has thrown out a portion of the lengthy criminal indictment against W.R. Grace and Co. that accused top executives of knowingly endangering miners and residents in Libby, where the company's vermiculite mine released dangerous cancer-causing asbestos into the air.
 
Unsealed in February 2005, the federal indictment charges seven of the company's current and former managers with conspiracy, Clean Air Act violations and other criminal charges. They are set to stand trial Sept. 11 in U.S. District Court in Missoula
