Cancer Lawsuits Possible in Ashland, Mass re Nyanza

It would be difficult but not impossible for families of those who contracted cancer after exposure to the chemicals dumped by Nyanza Inc. in Ashland Massachusetts, to sue for damages. 
 
The site, inactive since 1978, became an EPA superfund cleanup site shortly thereafter, and the dye companies who operated there are long insolvent. 
 
However a new study has linked the site's many chemicals, including mercury, lead, and chromium, to possible cancers, which could serve to nullify the statute of limitations. 
 
Children are known to have played and gone swimming in contaminated lagoons on the property. 
 


Lawyers: Nyanza lawsuit would be tough

ASHLAND -- A study linking the Nyanza chemical waste dump to cancer could bolster potential lawsuits against past operators of the dye factory, but winning claims involving Superfund properties is usually "incredibly difficult," according to members of a law firm that sues industrial polluters.
 
A Department of Public Health study on Nyanza’s link to cancer could allow sick Ashland residents to override statutes of limitations because the research just came out this week, a lawyer said.
