Unsafe Transplanted Tissue Prompts Canadian Lawsuit

A Vancouver B.C. woman has started the process for a class-action lawsuit against various defendants including a hospital and an ear bank. 
 
The woman had surgery on her eardrums after they were damaged during an airplane flight. The surgery involved donor cadaver tissue from an ear bank that has since been revealed as negligent in record-keeping and safety procedures. 
 
This put the woman and many other patients at risk of contracting serious diseases such as Hepatitis and HIV. 
 
The plaintiff herself has tested negative for these diseases.


Woman launches class action suit after eardrum surgery

VANCOUVER - A Vancouver woman who was shocked to learn she may have received infected donor tissue during reconstructive eardrum surgery in 1994 has launched what she hopes will be a class-action lawsuit against St. Paul's Hospital, the B.C. Ear Bank and a number of other defendants.
 
Margaret Birrell alleges the hospital and other defendants were negligent in the operation and supervision of the ear bank for failing to confirm the transplanted materials from cadavers were properly screened and sterilized and for failing to maintain accurate and complete records
