Okay Given for Suit Against Amtrak, MBTA

At a glance:

The Supreme Judicial Court in Massachusetts has ruled that a lawsuit against the MBTA and Amtrak may proceed. 
 
It concerns the death, seven years ago, of a young girl who was hit by a train while trying to negotiate a level crossing with her bicycle. 
 
The girl's parents contend that the train was speeding and that the engineer did not blow the whistle according to safety procedures.

ABINGTON -- Seven years after their teenage daughter was killed by a commuter train, Michael and Eileen Boyd have been given a green light to pursue their lawsuit against the Massachusetts Bay Transportation Authority and Amtrak.
 
The Supreme Judicial Court last month reversed a 2005 state Appeals Court decision that Suffolk Superior Court Judge Diane Kottmyer was correct in ruling in 2002 that there was not sufficient evidence for the case to be presented to a jury. The SJC ruled the case does merit a jury trial
